مطالب أولي النهىal-Ruhaybani

(وَإِنْ قَالَا) رَدَدْنَاهُ (لِنَأْخُذَ الْعِوَضَ مِنْهُ) لِأَنْفُسِنَا؛ (فَلَا شَيْءَ لَهُمَا) ؛ لِأَنَّهُمَا عَمِلَا مِنْ غَيْرِ جُعْلٍ، (وَلَهُ ثُلُثُ الْجُعْلِ) ؛ لِأَنَّهُ عَمِلَ ثُلُثَ الْعَمَلِ، فَاسْتَحَقَّ ثُلُثَ الْجُعْلِ، قَالَ الْمُوَفَّقُ: وَلَا أَعْلَمُ فِيهِ خِلَافًا.
