(فَإِنْ لَمْ يَعْلَمْ) الْمُلْتَقِطُ الثَّانِي بِالْمُلْتَقِطِ (الْأَوَّلِ، حَتَّى عَرَّفَهَا حَوْلًا) كَامِلًا؛ (مَلَكَهَا) الثَّانِي قَوْلًا وَاحِدًا؛ (لِعَدَمِ تَعَدِّيهِ إذَنْ) ، وَلَيْسَ لِلْأَوَّلِ انْتِزَاعُهَا مِنْهُ؛ لِأَنَّ الْمِلْكَ مُقَدَّمٌ عَلَى حَقِّ التَّمَلُّكِ
