(وَتَصِحُّ) الْوَصِيَّةُ (مِمَّنْ لَا وَارِثَ لَهُ بِنَحْوِ رَحِمٍ) كَفَرْضٍ أَوْ عَصَبَةٍ (بِجَمِيعِ مَالِهِ) .

رُوِيَ عَنْ ابْنِ مَسْعُودٍ؛ لِأَنَّ مَنْعَ مُجَاوَزَةِ الثُّلُثِ ثَبَتَ لِحَقِّ الْوَرَثَةِ، فَحَيْثُ لَا وَارِثَ لَهُ يَنْتَفِي الْمَنْعُ لِانْتِفَاءِ عِلَّتِهِ.
