مطالب أولي النهىal-Ruhaybani

(إلَّا أَنْ يَكُونَ الْمَالُ) الْمُخَلَّفُ (ظَاهِرًا لَا يَخْفَى) عَلَى الْمُجِيزِ؛ فَلَا يُقْبَلُ قَوْلُهُ إنَّهُ ظَنَّهُ قَلِيلًا؛ لِأَنَّهُ خِلَافُ الظَّاهِرِ (أَوْ تَقُومُ بَيِّنَةٌ) عَلَى الْمُجِيزِ (بِعِلْمِ قَدْرِهِ) - أَيْ: الْمَالِ - فَلَا يُقْبَلُ قَوْلُهُ، وَلَا رُجُوعَ لَهُ عَمَلًا بِالْبَيِّنَةِ
