مطالب أولي النهىal-Ruhaybani

(وَيَرِثُ صَغِيرٌ حُكِمَ بِإِسْلَامِهِ بِمَوْتِ أَحَدِ أَبَوَيْهِ) بِدَارِنَا (مِنْهُ) ؛ أَيْ: مِنْ الْمَيِّتِ الَّذِي حُكِمَ بِإِسْلَامِ الصَّغِيرِ بِمَوْتِهِ؛ لِأَنَّ الْمَنْعَ مِنْ الْإِرْثِ الْمُرَتَّبِ عَلَى اخْتِلَافِ الدِّينِ مَسْبُوقٌ بِحُصُولِ الْإِرْثِ مَعَ الْحُكْمِ بِالْإِسْلَامِ عَقِبَ الْمَوْتِ.
