(وَلَا يَمْلِكُ) وَكِيلٌ (بِإِطْلَاقِ) مُوَكِّلٍ فِي طَلَاقٍ (تَعْلِيقًا) أَيْ: أَنْ يُعَلِّقَ الطَّلَاقَ عَلَى شَرْطٍ (فَإِنْ عَلَّقَهُ لَمْ يَقَعْ) لِأَنَّهُ لَمْ يُؤْذَنْ فِيهِ لَفْظًا وَلَا عُرْفًا.
