(وَمَنْ أَتْلَفَ نَفْسَهُ أَوْ طَرَفَهُ خَطَأً فَهَدَرٌ كَعَمْدٍ) ؛ أَيْ: كَمَا لَوْ أَتْلَفَ نَفْسَهُ أَوْ طَرَفَهُ عَمْدًا، فَلَا دِيَةَ لَهُ إجْمَاعًا، وَجْهُ كَوْنِهِ لَا دِيَةَ لَهُ فِي الْخَطَأِ مَا رُوِيَ
