(وَإِنْ جَرَحَ وِرْكَهُ، فَوَصَلَ) الْجُرْحُ (جَوْفَهُ أَوْ أَوْضَحَهُ) فِي رَأْسِهِ (فَوَصَلَ) الْإِيضَاحُ (قَفَاهُ) فَعَلَى مَنْ جَرَحَ الْوِرْكَ فَوَصَلَ الْجَوْفَ (مَعَ دِيَةِ جَائِفَةٍ) حُكُومَةٌ (أَوْ) ؛ أَيْ: وَعَلَى مَنْ أَوْضَحَ شَخْصًا فَوَصَلَ قَفَاهُ مَعَ دِيَةِ (مُوضِحَةٍ حُكُومَةٌ بِجُرْحِ قَفَاهُ أَوْ) جُرْحِ (وِرْكِهِ) ؛ لِأَنَّ الْجُرْحَ فِي غَيْرِ مَوْضِعِ الْجَائِفَةِ، فِي غَيْرِ مَوْضِعِ الْمُوضِحَةِ فَانْفَرَدَ بِالضَّمَانِ، كَمَا لَوْ لَمْ يَكُنْ مَعَهُ جَائِفَةٌ أَوْ مُوضِحَةٌ.
