مطالب أولي النهىal-Ruhaybani

(وَمَتَى قَدِمَ الْخَصْمُ الْمُثْبَتُ عَلَيْهِ) الْحَقُّ عِنْدَ الْكَاتِبِ قَبْلَ الْحُكْمِ عَلَيْهِ (بَلَدَ الْكَاتِبِ؛ فَلَهُ الْحُكْمُ عَلَيْهِ) ؛ أَيْ: الْخَصْمِ بِالْحَقِّ (بِلَا إعَادَةِ شَهَادَةٍ) عَلَيْهِ إذَا سَأَلَهُ رَبُّ الْحَقِّ ذَلِكَ؛ لِسَبْقِ الشَّهَادَةِ.

[فَصْلٌ إذَا حَكَمَ عَلَيْهِ الْمَكْتُوبُ إلَيْهِ فَسَأَلَهُ أَنْ يَشْهَد عَلَيْهِ بِمَا جَرَى] فَصْلٌ
