(وَ) تَصِحُّ الْوَصِيَّةُ (مِنْ كَافِرٍ إلَى) كَافِرٍ (عَدْلٍ فِي دِينِهِ) لِأَنَّهُ يَلِي عَلَى غَيْرِهِ بِالنَّسَبِ فَيَلِي بِالْوَصِيَّةِ كَالْمُسْلِمِ
