(فَإِنْ مَنَعَهُ) رَبُّ الطَّعَامِ مِنْ أَخْذِهِ بِعِوَضِهِ (فَلَهُ) أَيْ: الْمُضْطَرِّ (قِتَالُهُ عَلَيْهِ) لِكَوْنِهِ صَارَ أَحَقَّ بِهِ مِنْهُ لِاضْطِرَارِهِ إلَيْهِ وَهُوَ يَمْنَعُهُ

معونة أولي النهىIbn al-Najjar
(فإن منعه) من أخذه بعوضه (فله قتاله عليه) في الأصح؛ لأن للمضطر حق فيه، لإضطراره إليه وهو يمنعه منه. فجاز له قتاله، لمنعه حقه.
