(وَتَلِفَ) بِغَيْرِ فِعْلِهِ (لَمْ يَضْمَنْهُ) لِأَنَّهُ غَيْرُ مُفَرِّطٍ وَلَا مُتَعَدٍّ وَإِذَا تَمَكَّنَ) مِنْ إرْسَالِهِ وَلَمْ يَفْعَلْ (ضَمِنَهُ) بِالْجَزَاءِ

(و) استمر مصاحباً له حتى (تلف) بغير فعله: (لم يضمنه) ؛ لأنه لم يوجد منه ما يقتضي ضمانه من تقصير ولا تعدٍّ وحيث لم يرسله
