(أو يخرج منه) أي: مما قطعه للحاجة إلى قطعه أو لوجوبه (رطبًا وعنبًا، اختاره القاضي، وجماعة) منهم الموفق والمجد، وصاحب "الفروع"؛ لأنّ الزكاة وجبت مواساة، ولا مواساة بإلزامه ما ليس في ملكه،
