(فلو خالفَ وفَعَلَ) بأن قدَّمَ المَقضيَّة على حجَّة الإسلام (فهو كـ) الحُرِّ (البالغ، يُحْرِمُ قبل الفَرْض بغيره) فينصرف فِعلُه إلى حجَّة الإسلام، ثم يقضي بعد ذلك.
