(وتصير أُمَّ ولدٍ له) ولو كان معسِرًا؛ لأنه استيلاد صيَّر بعضها أم ولد، فيجعل جميعها كذلك، كاستيلاد جارية ابنه، وهو أقوى من العتق؛ لكونه فعلًا، وينفذ من المجنون (والولد حُرٌّ ثابت النسب) للشُّبهة.
