(وإن عجز مَنْ هي) أي: الأرض الخراجية (في يده عن عمارتها، و) عن (أداء خراجها، أُجبر على إيجارها، أو رَفْع يده عنها؛ لتدفع إلى من يعمرها، ويقوم بخراجها) لأن الأرض للمسلمين، فلا يجوز تعطيلها عليهم.
