(لم تصح) مطلقًا (لاعتبار رضاه) وحال الغائب مجهول.

وذكر القاضي وأبو الخطاب في "تعليقهما": لو قال: أَقِلني، ثم دخل الدار، فأقاله على الفور؛ صح إن قيل: هي فسخ لا بيع؛ لأن البيع يشترط له حضور العاقدين في المجلس.
