(فإن قَبَضَ البعضَ) مما أسلم فيه ليأخذ منه كل يوم قَدْرًا معلومًا (وتعذَّر قبض الباقي، رجع بقسطه من الثمن، ولا يجعل للباقي فضلًا على المقبوض) لأنه مبيع واحد متماثل الأجزاء، فيقسط الثمن على أجزائه بالسوية كما لو اتَّحد أجله.
