كشاف القناعal-Buhuti

(رفع) المسلَم إليه (الأمر إلى الحاكم فقبضه) أي: المسلَم فيه (له، وبرئت ذمة المسلَمِ إليه فيه) أي: في ذلك المقبوض منه لأن الحاكم يقوم مقام الممتنع بولايته، وليس له أن يبرئ.
