(ويجب عليه) أي: الحاكم (ذلك) أي: بيع ماله، وقسم ثمنه (إن كان مال المفلس من غير جنس الديون، فإن كانت ديونهم من جنس الأثمان أخذوها) أي: الأثمان، إن وجدت في ماله، ولا بيع، لعدم الحاجة إليه، وإلا بيعَ بالأثمان، وقسمت بينهم.
