ثم بمن له عين مال أو عين مؤجرة أو مستأجرها من مفلس فيأخذها

(ثم) يبدأ (بمن له عينُ مالٍ) فيأخذها بشروطه؛ لما تقدم . (أو) له (عين مؤجرة) استأجرها المفلس منه، ولم يمض من مدتها شيء فيأخذها كما تقدم (أو) له منفعة عين هو (مستأجرها من مُفلِس، فيأخذها) لأن حقه متعلِّق بالعين والمنفعة، وهي مملوكة له في هذه المدة.
