(ولا يصح) التوكيل (بجعل مجهول) لفساد العوض (ويصح تصرُّفه) أي: الوكيل (بـ) عموم (الإذن) في التصرُّف (وله) أي: الوكيل حينئذ (أجرة مثله) لأنه عمل بعوض لم يسلم له.
