(وإن بناه) أي: الحائط (مائلًا إلى ملك غيره بإذنه، أو) بناه مائلًا (إلى ملك نفسه) لم يضمن لعدم تعدِّيه (أو مال) الحائطُ (إليه) أي: إلى ملك رَبِّه (بعد البناء، لم يضمن) رَبُّهُ ما تلف به.
