(وحيث وَجَب الضمانُ) فيما تلف بالجدار (والتالف آدميٌّ، فالدِّيَة على عاقلته) أي: عاقلة رَبِّ الحائط؛ لأنها تحمل دية القتل الخطأ، وشِبه العمد.
