(وليس للإمام إقطاع معادن ظاهرة أو باطنة) لما فيه من التضييق، وصحح في "الشرح" جوازه؛ لأن النبي - صلى الله عليه وسلم - "أقطعَ بلال بن الحارثِ معادِنَ القَبَليَّة، جليسها وغويرها (٣) " رواه أبو داود وغيره .
