(ولا يملكه) أي: الموات (بالإقطاع) لأنه لو ملكه ما جاز استرجاعه (بل يصير) المُقطَع (كالمتحجِّر الشارع في الإحياء) لأنه ترجح بالإقطاع على غيره، ويُسمَّى تملكًا لمآله إليه.
