(فإن وَطِئها أحدُهما؛ أَثِمَ؛ ولا حَدَّ عليه) لأنه وَطْءُ شُبهة؛ لوجود الملك لكل منهما (و) إن ولدت من أحدهما فـ ( ولده حُرٌّ) لما تقدم.
