(ولو كان تحته) أي: العبد (أحرار فأسلم، وأسلمن معه) أو في العدة بعد الدخول بهن؛ اختار منهن ثنتين، و (لم يكن للحُرَّة) التي يُمسكها (خيارُ الفسخِ) لأنهن رضين به عبدًا كافرًا، فعبدًا مسلمًا أَولى.
