(ومن أخذ منه) أي: النِّثَار (شيئًا؛ ملكه، ومن حصل في حَجره منه شيء؛ فهو له) سواء قصد تملّكه بذلك، أو لم يقصده؛ لأن مالكه قصد تمليكه لمن حازه، وقد حازه مَنْ أخذه، أو حصل في حجره، فيملكه
