(وإن كان) المؤلي (مظاهِرًا؛ لم يؤمر بالوطء) لأنه محرَّمٌ عليه قبل التكفير، فهو عاجز عنه شرعًا، أشبه المريض (ويقال له: إما أن تُكَفِّر) وتفيء (وإما أن تطلق) إزالة لضررها.
