وإن غصب عينا أو سرقها وأحرزها فسرقها سارق أو غصب بيتا فأحرز فيه ماله فسرقه منه أجنبي لم يقطع.

(وإن غصب) إنسان (عينًا، أو سرقها وأحرزها، فسرقها سارقٌ) لم يُقطع. (أو غصب بيتًا، فأحرز) الغاصب (فيه ماله فسرقه منه أجنبي؛ لم يقطع) لأن ذلك غير محترم.

فصل (ويُشترط) للقطع في السرقة (انتفاءُ الشُّبهة) لقوله - صلى الله عليه وسلم -: "ادرؤا الحدود بالشُّبهات ما استطعتم".
