(وقَدْر الفرقة ما عده الناس فِراقًا، كفُرْقَةٍ) تُبْطِلُ خيارَ المجلس في (البيع) لأن الشرع رتَّب على ذلك أحكامًا، ولم يبين مقدارًا، فوجب الرجوع فيه إلى العادة، كالقبض والحِرز.
