(وولي المُوَلَّى عليه) لصغر أو جنون أو سَفَهٍ (في قِسمة الإجبار بمنزلته) لقيامه مقامه. (وكذا) هو بمزلته (في قِسمة التراضي؛ إذا رآها مَصْلَحةً) كالبيع، وأولى.
