شرح منتهى الإراداتal-Buhuti

(وَإِنْ فَضَلَ عَنْهُ) أَيْ الدَّيْنِ شَيْءٌ مِنْ ثَمَنِ الرَّهْنِ (رُدَّ) الْفَاضِلُ (عَلَى الْمَالِ) ; لِأَنَّهُ انْفَكَّ مِنْ الرَّهْنِ بِالْوَفَاءِ، فَصَارَ كَسَائِرِ مَالِ الْمُفْلِسِ

(وإن فضل عنه) أي: عن الدين شيء من ثمن الرهن: (رد على المال) ؛ لأن الفاضل انفك من الرهن بالوفاء. فصار كسائر مال المفلس.
