(وَتَصِحُّ مُعَامَلَةُ قِنٍّ لَمْ يَثْبُتْ كَوْنُهُ مَأْذُونًا لَهُ) ; لِأَنَّ الْأَصْلَ صِحَّةُ التَّصَرُّفِ وَلَا يُعَامَلُ صَغِيرٌ لَمْ يُعْلَمْ الْإِذْنُ لَهُ إلَّا فِي مِثْلِ مَا يُعَامَلُ مِثْلُهُ فِيهِ و
