(وَيُعْتَبَرُ) لِوُجُوبِ إعْفَافٍ (عَجْزُهُ) أَيْ الْمُنْفَقِ عَلَيْهِ عَنْ مَهْرِ حُرَّةٍ أَوْ ثَمَنِ أَمَةٍ فَإِنْ قَدَرَ عَلَى ذَلِكَ لَمْ يَجِبْ عَلَى غَيْرِهِ.
