وَمَنْ مَاتَ فَوَارِثُهُ كَهُوَ لِقِيَامِهِ مَقَامَهُ ; لِأَنَّهُ حَقٌّ لِلْمَيِّتِ فَانْتَقَلَ إلَى وَارِثِهِ كَسَائِرِ حُقُوقِهِ.

(وَمَنْ مَاتَ) مِنْ وَرَثَةِ مَقْتُولٍ (فَوَارِثُهُ) أَيْ الْمَيِّتِ (كَهُوَ لِقِيَامِهِ مَقَامَهُ ; لِأَنَّهُ حَقٌّ لِلْمَيِّتِ فَانْتَقَلَ إلَى وَارِثِهِ كَسَائِرِ حُقُوقِهِ.

معونة أولي النهىIbn al-Najjar

(ومن مات) من ورثة المقتول: (فوارثه) أي: وارث من مات (كهو) أي: كمورثه. فيملك ما كان يملكه مورثه؛ لأنه حق للميت. فانتقل بموته إلى وارثه؛ كسائر حقوقه.
