[فصل: في الدعوى بالقليل] (فصل. وتصح) الدعوى

(بالقليل) وظاهره ولو لم تتبعه الهمة. ولا ينافي ذلك قولهم: أن القاضى لا يستعدي فيما لا تتبعه الهمة؛ لما في الاستعداء من المشقة الحاصلة بسبب ما هو أسهل منها.
