(قَوْلُهُ: أَوْ فِدَاءٍ مِنْ الْخُمُسِ إلَخْ) أَيْ أَنَّهُ

إمَّا أَنْ يَحْصُلُ الْفِدَاءُ بِمَالٍ يَأْخُذُهُ مِنْهُمْ وَيَضُمُّهُ لِلْغَنِيمَةِ، أَوْ يَحْصُلُ الْفِدَاءُ بِرَدِّ الْأَسْرَى الَّذِينَ عِنْدَهُمْ وَحِينَئِذٍ فَيُحْسَبُ الْقَدْرُ الَّذِي يُفَكُّ بِهِ الْأَسْرَى مِنْ عِنْدَهُمْ مِنْ الْخُمُسِ.

(أَوْ فِدَاءً) بِمَالٍ مِنْ الْكُفَّارِ أَكْثَرَ مِنْ قِيمَتِهِ أَوْ بِأَسِيرٍ مُسْلِمٍ عِنْدَهُمْ وَتُحْسَبُ قِيمَتُهُ مِنْ الْخُمُسِ، وَيُجْعَلُ الْفِدَاءُ فِي بَيْتِ الْمَالِ.
