"بعد مضاجعة" أو مباشرة فاحشة "من غير إنزال" ظانا أمه أفطر بالمس والقبلة لزمته إلا إذا تأول حديثا أو استفتى فقيها فأفطر فلا كفارة عليه وإن أخطأ الفقيه ولم يثبت الحديث لأن ظاهر الفتوى والحديث يصير شبهة قاله الكمال عن البدائع
