(فإن أجازه بغير حضرة صاحبه جاز) إجماعاً، لأنه إسقاط لحقه، فلا يتوقف على حضور الآخر، كالطلاق والعتاق، إلا إذا كان الخيار لهما وفسخ أحدهما فليس للآخر الإجازة، لأن المفسوخ لا تلحقه الأجازة
