الجوهرة النيرةal-Haddadi
قَوْلُهُ: (وَلَيْسَ لَهُ أَنْ يُمْسِكَهُ وَيَأْخُذَ النُّقْصَانَ) لِأَنَّ الْأَوْصَافَ لَا يُقَابِلُهَا شَيْءٌ مِنْ الثَّمَنِ وَلِأَنَّ الْبَائِعَ لَمْ يَرْضَ بِخُرُوجِ الْمَبِيعِ مِنْ مِلْكِهِ إلَّا بِجُمْلَةٍ سَمَّاهَا مِنْ الثَّمَنِ فَلَا يَجُوزُ أَنْ يَخْرُجُ بِبَعْضِهَا إلَّا بِرِضَاهُ.
