(وإن استأجرها) : أي الدابة (ليركبها فأردف معه رجلا) بحيث يستمسك بنفسه والدابة تطيق ذلك (فعطبت) الدابة (ضمن نصف قيمتها) ، لأنها تلفت بركوبهما وأحدهما مأذون له دون الآخر
