(وكل ذلك) المذكور (جائز) بحيث يثبت الملك للمدعى في بدل الصلح، وينقطع حق الاسترداد للمدعى عليه؛ لأنه سبب لرفع التنازع المحظور، قال تعالى:{ولا تنازعوا} فكان مشروعا.
