(قَوْلُهُ وَإِنْ حَلَفَ عَلَى الْأَبَدِ فَالْيَمِينُ بَاقِيَةٌ) ؛ لِأَنَّهَا مُطْلَقَةٌ وَلَمْ يُوجَدْ الْحِنْثُ إلَّا إنَّهُ لَا يَتَكَرَّرُ الطَّلَاقُ قَبْلَ التَّزْوِيجِ؛ لِأَنَّهُ لَمْ يُوجَدْ مَنْعُ الْحَقِّ بَعْدَ الْبَيْنُونَةِ؛ لِأَنَّ الْبَائِنَ لَا حَقَّ لَهَا فِي الْوَطْءِ
