الجوهرة النيرةal-Haddadi

قَوْلُهُ: (فَإِنْ دَفَعَهُ مَلَكَهُ وَلِيُّ الْجِنَايَةِ وَإِنْ فَدَاهُ فَدَاهُ بِأَرْشِهَا) وَكُلُّ ذَلِكَ يَلْزَمُهُ حَالًّا فَإِنْ لَمْ يَخْتَرْ الْمَوْلَى شَيْئًا مِنْ الدَّفْعِ، وَالْفِدَاءِ حَتَّى مَاتَ الْعَبْدُ بَطَلَ حَقُّ الْمَجْنِيِّ عَلَيْهِ.
