(وَإِلَّا) يُوجِبْ الْجُرْحُ قِصَاصَهُ (أَخَذَ) الْوَارِثُ (أَرْشَهُ) إنْ شَاءَ ; لِأَنَّ الْحَقَّ فِيهِ لَهُ دُونَ غَيْرِهِ. [بَابُ شُرُوطِ وُجُوبِ الْقِصَاصِ] شُرُوطِ وُجُوبِ
