(ثَانِيهَا) أَيْ الشُّرُوطِ (: عِصْمَةُ مَقْتُولٍ وَلَوْ) كَانَ (مُسْتَحَقًّا دَمُهُ بِقَتْلٍ لِغَيْرِ قَاتِلِهِ) لِأَنَّهُ لَا سَبَبَ فِيهِ يُبِيحُ دَمَهُ لِغَيْرِ مُسْتَحَقِّهِ
