(وَإِنْ وَجَبَ لِقِنٍّ قَوَدٌ أَوْ) وَجَبَ لَهُ (تَعْزِيرُ قَذْفٍ) وَنَحْوِهِ (فَلَهُ) أَيْ الْقِنِّ (طَلَبُهُ وَ) لَهُ (إسْقَاطُهُ) لِاخْتِصَاصِهِ بِهِ دُونَ سَيِّدِهِ ; لِأَنَّهُ لَا يَسْتَحِقُّهُ مَا دَامَ الْقِنُّ حَيًّا وَلَيْسَ لَهُ إسْقَاطُ الْمَالِ
