(لَكِنْ لَا يَسْتَوْفِيهِ) مَقْذُوفٌ (بِنَفْسِهِ) فَإِنْ فَعَلَ لَمْ يُعْتَدَّ بِهِ.

قَالَ الْقَاضِي: لِأَنَّهُ يُعْتَبَرُ فِيهِ نِيَّةُ الْإِمَامِ أَنَّهُ حَدٌّ
